This delivery agreement is binding between Aaron Rosstier doing business as MyTownNow, hereinafter "MyTownNow," and the undersigned, hereafter "customer." Customer will pay the above indicated amount for the above selected service(s). All communications for purposes of this contract shall be directed to MyTownNow's email address, aaron@mytownnow.net 2. All deliveries will only be made to the delivery address. If customer is not at home, the package will be left at the front door or in an area the customer designated in this contract above for packages to be left. Customer agrees for all deliveries to be left at the front door by not designating a specific alternative location for deliveries to be left. MyTownNow assumes no risk of loss once delivered to the front door or customer designated delivery area. 3. Customer agrees to reimburse MyTownNow in the manner customer indicates on each order form within twenty-four hours of purchase as indicated on purchase receipt. If Customer fails to do so, the customer's on-file credit card submitted in this contract will be charged for that purchase, plus a 2.9% processing fee that is non-refundable. The purchase amount may be refunded if the customer elects to return the purchased item. 4. MyTownNow agrees to deliver all items ordered by 12:00 noon to customer's delivery address by 11:59PM later that same day. MyTownNow will pick up and deliver groceries the customer has ordered at the nearest Kroger, Walmart or Meijer that offers grocery pickup at the agreed upon time as indicated by the "Grocery Delivery Time" email that will follow the submission of this contract. If MyTownNow fails to deliver groceries or any other items on time, customer may cancel the contract and receive a refund for the month in which the failure to deliver on time only, and not for any previous months. Customer then may elect to terminate the agreement, but such termination is not automatic. 5. This contract will continue until customer or MyTownNow cancels the contract. Customer may cancel anytime but will receive no refunds for past monthly fee charges absent breach of contract. MyTownNow may cancel this contract for any reason not prohibited by the US Constitution. 6. MyTownNow and Customer agree to indemnify and hold one another harmless against any claims of loss or damage arising from the delivery of the services covered by this service delivery agreement. 7. Customer may cancel this service delivery agreement at any time by providing written notice to the email contact at MyTownNow. 8. MyTownNow shall be considered an independent contractor of Customer. No formal employment contract is implied or established. 9. Both MyTownNow and Customer will treat all information related to this service delivery agreement as proprietary and confidential. No information shall be disclosed to third parties without approval from both MyTownNow and Customer.</p> 10. Failure to enforce or uphold any aspect of this service delivery agreement shall not be construed as a waiver of any other aspect of the agreement. 11. Should any aspect of this agreement be judged to be illegal or unenforceable, all other aspects of this agreement shall remain in full effect, and any nullified aspects of this service delivery agreement shall be replaced by new terms acceptable to both parties. 12. This service delivery agreement represents the entire agreement between MyTownNow and Customer. No other agreements, written or oral, are valid. 13. This service delivery agreement shall be governed by the laws of Kentucky. 14. The price shall be $35 per month for two local grocery deliveries and up to five items from any store withing eighty-nine zip codes (See paragraph 15) around Cincinnati. The price shall also be $35 per month for two non-local grocery deliveries per month. The price shall be $22.50 per month for one non-local delivery. MyTownNow may change the price for these services at any time with one week notice, a written notice of the price change that will be emailed to customer at his/her login email included above. 15.
